Court Guardianships

If somebody loses the capacity to make decisions, and doesn’t have a Power of Attorney in place, an intervention order or guardianship order may be required. Our solicitors are based in Glasgow and South Lanarkshire in Scotland and have many years of experience in helping our clients through the process of helping families deal with the problems that arise when a loved one loses capacity. Below are some of the most important legal and practical considerations.

Intervention & Guardianship Orders in Scotland

An intervention order is usually needed for a ‘one off’ matter, such as ending a tenancy or setting up a standing order for care charges.

If somebody’s affairs need ongoing management then a guardianship order is needed.

Both orders can be granted to give a person responsibility for property, financial and welfare concerns.

Guardianship Lawyers Glasgow

If you need a guardianship order, it’s important that you contact a lawyer with expertise in this complex area. The circumstances in which a guardianship order are commonly required include the following where a person cannot make decisions on their own and where a Power of Attorney isn’t already in place:-

  • Where a person suffers from a serious illness;
  • Following an accident, such as a car accident or accident at work where serious injuries are sustained. We can also help you claim for personal injury;
  • Through old age, where an elderly person develops a debilitating condition or illness such as Alzheimer’s disease, Parkinson’s disease or dementia.

  • Applying to the Scottish Courts

  • Granting a guardianship order requires court action (usually at Sheriff Court level) and may be an expensive procedure. This is why it is always better if you grant a Power of Attorney to somebody while you still have the capacity to do so.

Before making the application to the court to appoint a guardian or intervener, our solicitors will discuss with you the best approach for your circumstances and this will include consideration of the following:-

  • Whether a guardianship order or intervention order is best for you;
  • In the case of guardianship orders, who may be appointed as guardian (such as a professional or relative) and what powers and responsibilities they will have; and
  • What will happen throughout the legal process
